Seller Terms & Consignment Mandate
This document governs the relationship between CollectorElysium and sellers. It covers (A) third-party sellers who list their pieces on the marketplace, and (B) consignment, whereby a client entrusts a piece to CollectorElysium which sells it in its own name.
Article 1 — Purpose
These terms define the rights and obligations of sellers using the Platform, as well as the terms of the consignment mandate.
Article 2 — Eligibility and seller declaration
The seller declares that they are the lawful owner of each piece, that it is authentic, lawful, not stolen, and free of any pledge or claim. The seller indemnifies CollectorElysium against any claim relating to the provenance or authenticity of the piece.
Article 3 — Listing and curation
CollectorElysium reserves the right to accept or refuse any piece. Accepted pieces are authenticated, described and listed in accordance with the Platform's standards. The seller authorises CollectorElysium to use the photographs and information required for the sale.
Article 4 — Price and commission
The sale price is set by mutual agreement (or according to an agreed floor price). CollectorElysium receives a commission of 15% of the sale price. The seller receives the sale price net of this commission. No registration or authentication fee is charged in addition, save by specific written agreement.
Article 5 — Collection and payout
CollectorElysium collects the price paid by the buyer, then pays the seller the amount due within 24 hours following validation of the quality control of the piece. Payment is made by bank transfer to the IBAN provided by the seller in their account.
Article 6 — Consignment mandate
Under consignment, the consignor entrusts their piece to CollectorElysium, which sells it in its own name on behalf of the consignor. Ownership of the piece remains with the consignor until the sale. CollectorElysium keeps the piece in a secure location for the duration of the consignment and maintains cover appropriate to its value.
Article 7 — Listing duration and unsold pieces
CollectorElysium consignment: where a piece is entrusted to CollectorElysium on consignment, the mandate is concluded for a term of 3 months, renewable by agreement. At the end of this period, if the piece has not been sold, the consignor may: (i) extend the listing, (ii) revise the price, or (iii) recover the piece. Return is made in person at the showroom, free of charge, or by secure shipment at the consignor's expense.
Third-party seller listings on the marketplace: where a seller lists a piece themselves on the marketplace, no time limit applies; the listing remains active until the seller removes it, and the seller may amend or withdraw it at any time before it is sold.
Article 8 — Non-authentic pieces
If a piece listed or sold via the Platform proves to be not authentic, the sale is cancelled, the buyer is refunded in full by CollectorElysium, and the seller bears the consequences: restitution of any sums received, payment of costs incurred (expert assessment, return, refund of the buyer) and, where applicable, permanent exclusion from the Platform. CollectorElysium reserves the right to pursue any remedy and to report the piece to the competent authorities.
Article 9 — Obligations and prohibitions
The seller undertakes not to circumvent the Platform in order to deal directly with a buyer met through CollectorElysium, and not to offer counterfeit pieces or pieces of doubtful origin. Any breach may result in suspension or closure of the account.
Article 10 — Seller taxation and reporting obligations
The seller is solely responsible for their tax and reporting obligations in respect of the sums received. Pursuant to the "DAC7" directive, CollectorElysium collects the required information and reports the income of the sellers concerned to the tax authorities annually.
Article 11 — Term, termination, disputes
CollectorElysium may suspend or close a seller account in the event of a breach. These terms are governed by French law; any dispute falls within the jurisdiction of the competent courts of Paris.
