Terms of service

Article 1 — Purpose

These Terms of Use define the conditions of access to and use of the CollectorElysium Platform, an online marketplace dedicated to the sale of pre-owned luxury pieces (leather goods, watches, jewellery and accessories from luxury houses). They apply to every user: visitor, buyer or seller.

Article 2 — Role of CollectorElysium

CollectorElysium operates a platform connecting sellers and buyers and acts, depending on the case, as:

• intermediary for sales made by third-party sellers (CollectorElysium is then not a party to the sale);
• seller for pieces offered under its own name, whether from its own stock or from pieces entrusted to it on consignment.

In all cases, CollectorElysium provides a curation and authentication service for the pieces offered for sale.

Article 3 — Registration and account

Access to buying and selling functions requires the creation of an account. The user warrants the accuracy of the information provided and undertakes to keep their credentials confidential. An account is strictly personal. The user must be of legal age and have legal capacity.

Article 4 — User obligations

Each user undertakes to use the Platform in good faith, not to offer counterfeit, stolen or unlawfully sourced pieces, and to comply with applicable law, in particular regarding anti-money laundering and the traceability of goods.

Article 5 — Curation and authentication

CollectorElysium reserves the right to accept, refuse or withdraw any piece that does not meet its standards of quality, condition or authenticity, without obligation to justify its decision. Authentication is carried out by CollectorElysium's experts prior to listing and/or shipment (see the authenticity guarantee, Terms of Sale, Article 6).

Article 6 — Liability

CollectorElysium implements the means necessary for the proper functioning of the Platform without guaranteeing uninterrupted availability. For sales between a third-party seller and a buyer, CollectorElysium is not a party to the contract of sale; its liability is limited to its obligations as a platform operator and to the authentication obligation it voluntarily assumes under the authenticity guarantee.

Article 7 — Personal data

The processing of data is described in the Privacy Policy.

Article 8 — Amendments

CollectorElysium may amend these Terms of Use at any time. The applicable version is the one in force on the date the Platform is used.

Article 9 — Governing law and disputes

These Terms of Use are governed by French law. See the Terms of Sale for mediation and jurisdiction.
