Terms of sale

These Terms of Sale govern sales concluded on the Platform. Where necessary, they distinguish between sales made by CollectorElysium (own stock and consignment) and sales made by third-party sellers.

Article 1 — Scope

Any order placed on the Platform implies unreserved acceptance of these Terms of Sale.

Article 2 — Identity of the seller

For each piece, the Platform indicates whether the seller is CollectorElysium or a third-party seller. This information determines the identity of the party to the contract of sale. For sales by a third-party seller, CollectorElysium acts as intermediary and as authentication and payment-collection provider.

Article 3 — Products

The pieces offered are pre-owned goods, unique or in limited quantity. Each listing specifies the brand, model, condition and authentication details. Photographs aim for the greatest possible fidelity; slight variations (patina, shade) inherent to pre-owned goods are possible and do not constitute a defect.

Article 4 — Prices

Prices are shown in euros (and converted into the display currency for information only), all taxes included. CollectorElysium pieces sold on consignment are subject to the margin VAT scheme (Article 297 A of the French General Tax Code); VAT is not recoverable by the buyer. Delivery costs and, where applicable, import duties and taxes are stated before the order is confirmed.

Article 5 — Order and payment

The order is firm once payment has been made in full. Payments are processed securely by the Platform's payment provider. For pieces entrusted by third-party sellers or held on consignment, CollectorElysium collects the price and then settles with the seller, after deduction of its commission.

Article 6 — Authenticity guarantee

CollectorElysium guarantees the authenticity of every piece sold on the Platform, including pieces offered by third-party sellers. Each piece is authenticated by its experts before listing and/or before shipment. Should a delivered piece be established as not authentic by a serious and adversarial expert assessment, the buyer is entitled to a full refund (price and delivery costs) upon return of the piece in its original condition, within 30 days of delivery. This guarantee is a contractual undertaking given by CollectorElysium to the buyer; where the piece comes from a third-party seller, CollectorElysium then exercises its recourse against that seller.

Article 7 — Legal guarantees

For sales in which CollectorElysium is the professional seller, consumer buyers benefit from the legal guarantee of conformity (Articles L. 217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). For sales concluded with a non-professional third-party seller, these guarantees specific to professionals do not apply; CollectorElysium's authenticity guarantee (Article 6) remains available to the buyer.

Article 8 — Right of withdrawal and returns

For sales in which CollectorElysium (or any other professional seller) is the seller, consumer buyers have a 14-day right of withdrawal from receipt (Articles L. 221-18 et seq. of the French Consumer Code), allowing the piece to be returned without reason. For sales concluded with a non-professional third-party seller (private individual), the statutory right of withdrawal does not apply: such sales are final, and the buyer is informed of this at the time of purchase. Article 10 — Mediation and disputes

Where a dispute is not resolved amicably, consumer buyers may use the European online dispute resolution platform (ec.europa.eu/consumers/odr). Failing resolution, the French courts have jurisdiction, subject to the rules protecting consumers.

Article 11 — Governing law

These Terms of Sale are governed by French law.
